On 1 November 2021, the Prohibition of Unfair Trading Practices Law entered into force. The purpose of this law is is to prohibit unfair trading practices throughout the supply chain of agricultural and food products and restrict the use of non-food retailers purchasing power against suppliers. With the Prohibition of Unfair Trading Practices Law entry into force, the Unfair Retail Trade Practices Prohibition Law became invalid.
The law prohibits unfair practices and the setting of unfair terms for payments for delivered goods, as well as provides liability for the violations committed. In case of non-compliance with the prohibitions listed in the Prohibition of Unfair Trading Practices Law, the purchaser is provided for liability for the violations committed.
From 20 April 2022, the relevant cooperation agreements should be adapted to the provisions of the Prohibition of Unfair Trading Practices Law.
